If you are involved in an accident, knowing what to do may help alleviate some of the anxiety that an accident causes.

  1. Call for an ambulance if anyone is injured. It is not a good idea to try to treat the injured person yourself unless you have training in first aid.

  2. Exchange Information with the other drivers involved in the accident. Be sure to get their names and addresses and the names and identification numbers of their insurance companies. Ask to see driver's licenses, registrations and insurance cards. Make sure a police report has been filed and get a copy of it for your files.

  3. It is best not to have any discussion with the other parties. You may say something that is inaccurate which can be used against you in the future. Tell the police officer your version of the accident.

  4. Attempt to get the name, address and phone number of any witnesses to the accident.

  5. Be sure to go immediately to an emergency hospital if there are injured. Tell the doctor every complaint and injury you have, no matter how minor you may think it is. A serious internal injury may not show immediately.

  6. Notify your insurance company. If you fail to notify your insurance company immediately after the accident, they have the right to refuse to cover the claim.

  7. File a Pennsylvania Auto Accident Claim:

a. You should file a third party claim if you are reasonably sure the auto accident was the fault of the other party. After you make a claim, the insurance company will look at the claim and determine who was at fault. If it is the person they insured, they will determine the amount of damages to offer you. They usually do not make an offer until all the medical treatment is finished.

b. If their offer is acceptable to you, then they will ask you to sign a release and they will make the payment to you. If you do not feel that they are compensating you enough, you can reject their offer and they may make another offer. If you still are not happy with their offer, then you can take the matter to court.

c. Contact IIHC. We can refer you to a Pennsylvania personal injury attorney who can answer questions about your legal rights. Do not wait – the best time to contact us in regards to a car accident is right after the accident occurred.
